PalFish User Service Agreement
This "User Service Agreement" (hereinafter referred to as the "Agreement") is a consensus decision on the PalFish product or service between Service recipient(hereinafter referred to as "you" or "user") and PALFISH PTE. LTD., Ltd. (hereinafter referred to as "PALFISH" or "PalFish"). Before you start using PALFISH products, please be sure to read carefully (minors should read with a guardian) and fully understand this agreement, especially the terms related to your personal information, rights and interests, and the opening and use of paid services Special terms.
Unless you fully accept the entire content of this agreement, you may not be able to use the Panyu products, or or the purpose can not be achieved. If you choose to use PalFish products, it is deemed that you have fully understood this agreement and promised to accept the constraints of the validity of the agreement.
1. The scope of the Agreement

2. Use PalFish products
2.1 Users can download PalFish software programs through any legal channels to their legally terminal devices. However, unless special authorization is obtained, the user shall not adapt, copy or trade the software program of PalFish in any form.
2.2 Once a user opens the PalFish in his terminal device, it is deemed to use the PalFish product. In order to fully realize all the functions of the PalFish, users may need to connect their terminal equipment to the Internet.
2.3 PALFISH authorized users have the permanent, non-transferable, non-exclusive and non-commercial right to use PalFish products in the People’s Republic of China, but this right is not transferable, and PALFISH also reserves the right to withdraw it under any necessary circumstances.
3. Account
3.1 PalFish provides users a registration channel, and users have the right to choose a legal combination of characters as their account, and set a password that meets the security requirements. The account and password set by the user are the credentials for the user to log in and use the product or receive the service as a registered user.
3.2 Your registered account in PalFish is for your own use only, and it is forbidden to give, borrow, rent or sell. If PALFISH finds or has reason to suspect that the user is not the initial registrant of the account, it has the right to suspend or terminate the provision of services to the registered account without notice, and has the right to cancel the account without bearing legal responsibility. The resulting losses, including but not limited to interruption of user communication, clearing of user data and information, etc., shall be borne by the user.
3.3 The user is responsible for maintaining the security and confidentiality of the personal account and password. The user is fully responsible for all activities undertaken in the name of his registered account, including the modification of user data, the speeches and other operational behavior on the PalFish APP. Therefore, users should attach great importance to the confidentiality of their account numbers and passwords. If they find that others use their account numbers without permission or any other security breaches occur, they should immediately notify DUwo Technology. However, the user shall be responsible for the leakage of the password for any reason.
3.4 The account can be retrieved in a timely manner according to the appeal channel of DUwo Technology after the user account is lost or forgotten, The user should provide personal password protection information that can increase the security of the account. The user can fill in the appeal form with the initial registration information and personal password protection information and apply to Duwo technology to retrieve the account. The password recovery mechanism of Duwo technology is only responsible for identifying the correctness of the information filled in the appeal form and the system record data. Not for identifying whether the complainant is the person who has the right to use the real account. PALFISH does not assume any responsibility for any loss caused by the user being appealed by others in an impersonal name. The user agrees that the account and password storage responsibility rests with the user. PALFISH does not promise that the user will be able to retrieve the account if the account is lost or the password is forgotten.
3.5 The user shall ensure the authenticity of the identity information filled in when registering an account, and any responsibility arising from illegal, untrue, or inaccurate user information shall be borne by the user. The user should continuously update the registration information to meet the timely, detailed, truthful and accurate requirements. All the originally typed information will be quoted as the user's account registration information. PALFISH will not take any responsibility if the problem caused by the user's registration information which is not true, as well as the consequences of the problem. If the information provided by the user is inaccurate, untrue, or illegal, or if we have reason to suspect that it is wrong, false or illegal, or display advertisements, unserious content and irrelevant information in personal data, we have the right to suspend or terminate the provision of services to users, cancel the account, and refuse users to use all or any part of PalFish products now and in the future. Therefore, all losses incurred shall be borne by the user.
3.6 In addition to self-registering PalFish accounts, users can also choose to use PalFish account management platform to authorize the use of their legally owned WeChat and Tencent QQ accounts to register and log in PalFish. When the user registers with the above-mentioned existing account, the relevant agreement on the account shall also apply.
4、Legal requirements for user behavior
4.1 The user shall abide by the laws of the People's Republic of China when using the products of PalFish. Users shall not use PALFISH service or products to engage in behaviors that violate the above-mentioned laws, regulations, policies, and infringe the legal rights of others.
4.2 Any plug-ins, or third-party tools to interfere, destroy, modify or exert other influences on the normal operation of PalFish products are prohibited without PalFish’s permission or authorization.
4.3 You are not allowed to use or target PalFish products to conduct any behavior that endangers computer network security, including but not limited to: using unauthorized data or accessing unauthorized servers/accounts; accessing public computer networks or other people’s computer systems without permission and delete, modify, or increase the stored information; attempting to probe, scan, test the weakness of the PalFish product system or network or perform other behaviors that undermine network security without permission; attempting to interfere with or disrupt the normal operation of the PalFish product system or website, Deliberately disseminate malicious programs or viruses and other acts that disrupt and interfere with normal network information services; forge TCP/IP data packet names or part of the names.
4.4 Without the permission of PALFISH, you are not allowed to conduct any commercial activities such as advertising and selling products in PalFish.
4.5 In any case, if PALFISH has reason to believe that any behavior of the user violates or may violate the above agreement, PALFISH may terminate the provision of services to users at any time without any prior notice.
5. Personal information protection
5.1 You may need to fill in some necessary information during the process of registering an account or using PalFish products. If there are special regulations in national laws and regulations, you need to fill in the true identity information. If the information you fill in is incomplete, you will not be able to use related products or services or will be restricted in the course of use.
5.2 You can browse and modify the personal identity information submitted by yourself at any time, but for security and identification (such as number appeal service) considerations, you may not be able to modify the initial registration information and other verification information provided during registration.
5.3 Various security technologies and procedures will be used to establish a complete management system to protect your personal information from unauthorized access, use or disclosure. However, users also understand that the openness of the Internet and technological updates are very fast, and PALFISH will not be responsible for the leakage of user information due to factors beyond the control of PALFISH.
5.4 PALFISH will not transfer or disclose your personal information to any unaffiliated third party, unless:
(1) Relevant laws and regulations or the requirements of courts and government agencies; or
(2) Transfer to complete merger, division, acquisition or asset transfer; or
(3) Necessary to provide the service you request.
5.5 Users should be careful not to disclose their various property accounts, bank cards, credit cards, third-party payment accounts and corresponding passwords and other important information in use of PalFish, otherwise any losses caused will be borne by the users themselves. Users should not display, upload or disseminate information that considered to be private through PalFish.
5.6 Under the following circumstances, PALFISH has the right to use the user's personal information:
1) When conducting promotions or sweepstakes, PALFISH may share the user’s personal information with sponsors. Under these circumstances, PALFISH will prompt before sending user information, and users can do so by not participating in promotions or sweepstakes to terminate the transfer process；
2) PALFISH may cooperate with a third party to provide users with relevant network services. In this case, if the third party agrees to assume the same responsibility for protecting user privacy as PALFISH, then PALFISH has the right to provide the third party with the registration information, etc.;
3) Under the premise of not disclosing the private information of a single user, PALFISH has the right to analyze the entire user database and make commercial use of the user database. PALFISH uses the email you submitted to send notifications related to PALFISH. Except for the aforementioned use and your personal behavior or consent disclosure, PALFISH will not display or share your e-mail information to any third party on the network.
5.7 When the user registers and uses PalFish products as a teacher, he has fully understood and agreed that PalFish products provide the student's parents or guardians with the function of supervising the lessons, that is, the student's parents or their guardians have the right to view the class videos.
6. User comment rules
6.1 The user shall not publish the following information in the PalFish product:
(1) Opposing the basic principles established by the Constitution;
(2) Endangering national security, leaking state secrets, subverting state power, and undermining national unity;
(3) Damage to national honor and interests;
(4) Inciting ethnic hatred, ethnic discrimination, and undermining ethnic unity;
(5) Inciting regional discrimination or hatred;
(6) Undermining the state's religious policies and promoting cults and superstitions;
(7) Spreading rumors, disturbing social order and undermining social stability;
(8) Spreading obscenity, pornography, gambling, violence, murder, terror or instigating crime;
(9) Insulting or slandering others, infringing on the lawful rights and interests of others;
(10) Violent intimidation, threats to others, and human flesh searches;
(11) Disseminating the private information of the minor without obtaining the written consent of the legal guardian of the minor under the age of 18;
(12) Spreading foul language and harming public order and good customs;
(13) Infringing on the intellectual property rights of others;
(14) Distribute commercial advertisements or similar commercial solicitation information;
(15) The published information is meaningless, or uses a combination of characters deliberately to avoid technical review;
(16) Other information prohibited by laws, regulations and rules.
6.2 PALFISH will take management measures such as banning calls, deleting comments, banning messages, and permanently closing accounts as appropriate for users who violate the above commitments. Comments on suspected crimes will be kept on file and truthfully reported when investigating by relevant government agencies.
6.3 PALFISH will improve the public reporting platform, and users are welcome to supervise and report various illegal communication activities and illegal and harmful information so as to jointly create a clear cyberspace.
7. Service alteration, interruption and termination
7.1 You understand and agree that the PalFish products and services are provided in accordance with the status that can be achieved by existing technology and conditions. PALFISH will do its best to provide you with services to ensure the continuity and security of the service; but PALFISH cannot foresee and prevent legal, technical and other risks at any time, including but not limited to force majeure, viruses, Trojan horses, hacker attacks, System instability, third-party service defects, government actions and other reasons may cause service interruption, data loss, and other losses and risks.
7.2 Users must understand that in order to serve the needs of overall operation, PALFISH has the right to modify, suspend, or terminate various services in PalFish products without prior notice to the user after the announcement and notice without compensation for the user or any third party.
8. Intellectual Property
8.1 Without the consent of the relevant right holders, users are not allowed to reverse engineer, reverse compile, or reverse compile relevant web pages, applications, software and other products involved in PalFish products and services.
8.2 When users publish and upload text, pictures, videos, software, performances and other user-original information when using PalFish products and services, this intellectual property belongs to the user, but the user’s publishing and uploading behavior indicates that the information is not exclusive to PALFISH revocable and transferable authorization.
8.3 Users shall ensure that the text, pictures, videos, software and performances uploaded when using PalFish products and services do not infringe any third-party intellectual property rights. Otherwise, PALFISH reserves the right to remove the infringing information and is not responsible for it. For the aforementioned third party's claims, users should bear their own responsibilities, and PALFISH has the right to disclose users' personal information in accordance with relevant laws and regulations.
9. Legal Liability Statement
9.1 PALFISH is not responsible for ensuring the truthfulness, accuracy and completeness of any information, content, or advertising and other information (hereinafter collectively referred to as "information") obtained from this website. If any organization or individual conducts any behavior through the above-mentioned "information", they must identify the authenticity by themselves and carefully prevent risks. Otherwise, for whatever reason, PALFISH will not bear any direct, indirect, incidental or derivative losses and liabilities arising from the action and/or behavior occur with this website.
9.2 PALFISH does not guarantee (including but not limited to):
(1) PALFISH is fully suitable for the user's requirements;
(2) PALFISH is not disturbed, timely, safe, reliable or error-free; any products, services or other materials obtained by users through PALFISH meet the expectations of users;
(3) Any errors in the software will be corrected.
9.3 Any profit, business reputation, data loss or other tangible or intangible losses caused by the following reasons, PALFISH shall not be liable for any direct, indirect, incidental, special, derivative or punitive compensation liability (even if PALFISH has previously been informed of such compensation):
(1) The use or unavailability of PALFISH;
(2) PALFISH is not disturbed, timely, safe, reliable or error-free; any products, services or other materials obtained by users through PALFISH meet the expectations of users;
(3) Any errors in the software will be corrected.
(4) Statements or actions made by any third party in this service;
(5) Users purchase goods or services from third parties based on the advertising information published in Banyu;
(6) Other matters related to PALFISH, except those expressly stipulated in this user agreement.
10. Indemnity
The user violates national laws and regulations or the provisions of this agreement, or the user infringes on any rights of others, which derives or causes any third party to file any claim or request to PALFISH, including but not limited to litigation costs, attorney fees, travel expenses, and settlement amount , Fines, or the amount of damages or software usage fees stipulated in the effective legal documents, which cause losses to PALFISH, the user shall compensate for all losses suffered by PALFISH and eliminate the impact.
11. Other terms
11.1 The conclusion, execution and interpretation of this agreement and dispute resolution shall be governed by Chinese laws. If any provisions of this agreement are invalid due to conflicts with the laws of the People's Republic of China, these terms will be as close as possible to the original intent of this agreement to re-analyze, and other provisions of this agreement should still have full force and effect. The place of signing of this agreement is the area where PALFISH is located. If there is a dispute between the user and PALFISH, both parties agree to submit the dispute to the Beijing Arbitration Commission for arbitration.
11.2 This agreement may be modified due to changes in national policies, products and implementation environment. PALFISH will post the modified agreement on the website. If you disagree with the revised agreement, please stop logging in and use PalFish products and services immediately. If you log in or continue to use PalFish products and services, it will be deemed to have approved the revised agreement.
